This website, Who is Nicka Smith (“website), is a business owned, created, and maintained by Nicka Smith (“owner”). For questions or concerns, please contact me. By purchasing courses on this website, you (“customer”) agree to the following terms and conditions.

License

Your payment hereby grants you a license to use the purchased on-demand webinar course(s). This license is personal to you and cannot be shared or exchanged with others. You are not purchasing any rights to the materials or copyright, only the right to view the material. You agree not to distribute or duplicate the materials in any way, in whole or in part, other than to print the syllabus for your personal use. You cannot store the materials on a network or on the Internet where the intent is to share files or copies of files. Your access license may be revoked if this license is violated and legal action will be pursued.

Registration

Registration is conducted by filling out an online form. Upon receipt of both the registration and payment (via Paypal), the customer will be sent a confirmation of registration by e-mail with a link to view the purchased course(s).

Payment

The course fee is due upon registration, and due to the nature of services provided, this fee is nonrefundable. Registration is binding upon receipt of the confirmation of registration. A space is guaranteed upon receipt of the course fee by the owner.

Price

Unless expressly stated otherwise, all prices listed are final and are payable in U.S. dollars. In case of default or reversal in payment, customer is obligated to pay the necessary fees due and any additional charges that are incurred as a result of default/reversal.

Fees are subject to change at any time, with or without notice.

Availability

Courses are available for one calendar year/365 days from the date of purchase. Following that date, access to courses will expire and will need to be repurchased.

Copyright

The content of all materials of all courses or other services is and remains the sole intellectual property of the owner. Duplication for display at genealogical society meetings is only permissible upon expressed, written consent by the owner and following payment for access to said materials. In the case of a violation of these stipulations, the customer shall pay the owner the fee(s) required. Furthermore, the owner expressly reserves the right to claim further damages.

Privacy

While this website respects the right of its customers to protect their personal information and maintains the strictest policies to maintain privacy, no guarantee is made regarding any information you provide the website and/or it’s owner. The customer is solely responsible for maintaining the secrecy of any passwords or other account information.
